Q Do you take cases – such as personal injury, caused by a road traffic accident – on a "no win no fee basis"?
A Yes, although it depends on the nature and circumstances of the claim. Sometimes, it may not be advantageous to either you or us.

Q I am a Landlord and have a problem with my Tenant. Can you help me remove him and re-posses my property?
A Yes. The remedies that may be open to you will depend on whether it is a business property or a residential property and also on the tenancy agreement.

Q How long does a divorce take to complete?
A 4 to 6 months depending on circumstance to include children, financial affairs and so forth, in which case it could take longer.

Q Can you take my case on Legal Aid?
A Only in Family cases.

Q Do you serve clients in the Swindon area only?
A These days, technology allows us to act for a client wherever they are. Indeed, our clients come from such places as London, Bristol, Gloucester, Bath, Cirencester, - as far as Zimbabwe in Africa and Florida in America!

Q If you deal with the sale and purchase of my house, do I get a discount?
A No, unless we have specifically agreed this.

Q Do you provide a fixed fee service?
A Yes, but only for certain types of work, such as drafting your Will, Conveyancing, Debt Recovery, Commercial deals. Please ask us for details.

Q My business is going through a difficult time. Can I make any of my staff redundant?
A Probably, but it depends on the circumstances in each case. Furthermore, you need to follow proper procedures to avoid a claim for unfair dismissal. It is vital that you take legal advice, prior to taking any steps to make an employee redundant.

Q What is Collaborative Law or Practice?
A A series of four way meetings whereby you sign a participating agreement to resolve the issues without going to Court.

Q Who can be a Collaborative Practitioner?
A A fully trained professional and registered practitioner.

Q What are ancillary proceedings?
A Proceeding in divorces dealing with the property finances, pensions and businesses' of the parties. Usually subject to a separate application within the divorce proceedings.

Q What are Cohabitation and Civil Partnerships?
A Cohabitation is where parties live together as partners. There can be cohabitation or Prenuptial agreements regulating arrangements. A Prenuptial agreement is one made prior to marriage with the intent that it binds the parties to the terms before and after marriage. They have no legal standing at present except the agreement and terms can have a bearing on any divorce ancillary proceedings when considered by the Court.

Q What are Residence and Contact Orders?
A A Residence Order provides for a child or children to live with one party/ parent. A Contact Order provides for access to the child/children by a party/parent.

Q What is meant by Joint Tenant or Tenant in Common?
A In marriage usually parties own a property as Joint Tenants i.e. equally, and on death of one, ownership passes to the other. Sometimes, usually if not married, parties own as Tenants in Common, whereby the property is owned together in specified shares, on death passing under their will or intestacy.

Q What is Pension Sharing?
A In divorce after the Decree Absolute, an Order for Pension Sharing enables a pension to be shared between the parties either by both remaining in the scheme or one having funds passed to another scheme in their own name.
