Know your Wedding Rights
In the current economic climate an increasing number of couples are choosing to rein in the amount they spend on their special day. Even if a bride and groom are planning their wedding on a small budget, they will still want to ensure that they get what they pay for.
Whilst bad weather cannot be avoided, suppliers not delivering what has been agreed can be can be very upsetting. Supplier problems can include the wedding car not turning up on time, flowers being different to what had been ordered, the caterers providing an inadequate service to what had been promised, or poor photography.
Nita King, Partner at Lemon&Co Solicitors, comments: “If things don’t turn out to be quite as perfect as you had hoped, the most important thing is to know your rights. It may be possible to claim against a supplier for any misrepresentation and/or breach of contract for their failure.”
Lemon&Co’s top tips for knowing your rights
If you have recently experienced an unsatisfactory service on your wedding day there are a series of points to consider:
- Always read the supplier’s standard terms (the “small print”) before signing an agreement and ensure you are happy. If not ask that the terms of the contract be amended
- The agreement reached is a legally binding contract whether in writing or spoken and you as a customer, have a right to expect those services to be delivered as they were agreed
- Were any oral representations made prior to any agreement for the supply upon which you relied on and they turned out to be false? If so you may have a claim in the law of misrepresentation
- If a service provider failed to meet the agreement, in the first instance speak amicably with the provider. If amicable communication fails, it may be necessary to seek legal advice and perhaps bring a claim through the courts
- If legal action is taken the contract agreed and photographic, oral or documentary evidence will be used to determine your success in the making the claim
Nita King concludes: "The most important advice for anyone who has experienced an unsatisfactory service on their wedding day, and is unable to reach a satisfactory conclusion to the dispute, is to seek legal help immediately which will put you on the right course and thus reducing any further distress.”
